Youth Justice, Community Safety and Children’s Rights in Australia

Abstract Australian children have few legal rights and in the context of youth justice, community safety tends to be prioritised over best interests wellbeing children. “Tough on crime” approaches justice law policy been influenced by penal populism, whilst voices practitioners who work with young people commit offences remain largely ignored. We interviewed 92 criminal settings a low socioeconomic area Queensland, Australia, ascertain their views effectiveness interventions community. Practitioners recognised need ensure when dealing offending behaviour children, but they felt that current responses do not achieve this goal. Instead, were favour children’s so causes addressed. Whilst did use rights-based language, suggestions for reform consistent protection fundamental as international law.
